Motorcyclist’s Family Wins at Trial

A jury awarded $2.8 Million to the survivors of Palm Coast, Florida man after he was struck and killed while riding his motorcycle and another motorist failed to yield the right of way on May 30, 2007. The victim was a manager at a Wal-mart and was the father to a five year-old daughter.

“After the issue of liability was determined by Circuit Judge Richard Graham, the jury assessed how much damages should be paid to Heikkila's survivors.

In addition to $1 million awarded to Heikkila's 5-year-old daughter, Ryleigh, his parents will each receive $500,000 under the verdict. Another $798,000 was awarded for economic damages, including $4,200 for funeral expenses.”

We often see motorcyclists riding the streets of Raleigh, Cary, Durham and the rest of North Carolina. The truth is motorcyclists do get hurt by negligence of the car drivers around them. Often times insurance adjusters feel they can deny these cases automatically because they feel they can make out a contributory negligence claim and the jury will automatically find that the motorcyclist was at fault.
