Obstetric Malpractice
We are committed to helping children, and this has led our firm to be involved in numerous cases involving obstetric malpractice (OBGYN). Though rare, physician and nursing malpractice in the delivery room can lead to devastating results for the child and its family. Obstetric malpractice is, by definition, always avoidable, and the family should not have to shoulder the entire burden of someone else’s tragic mistake.
Cerebral Palsy & Brain Injury
The day you deliver your child should be one of the most joyful days of your life. For approximately 2 out of every 1000 women in the industrialized world, however, it is the beginning of a lifelong struggle, as their child will have cerebral palsy.
Cerebral palsy is not a true diagnosis, but a description of a type of child brain injury that can occur during delivery. Sadly, the failure to perform a prompt cesarean section, misuse of forceps, misuse of vacuum suction, and most recently, the continued abuse of Pitocin, can all contribute to serious brain injuries of your child.
The missteps listed above can cut off blood an oxygen supply to the brain of the baby. On average, it can take as little as 20 minutes before the baby suffers a devastating insult and injury to the brain. Even after the initial insult, however, prompt and proper treatment of the infant with hypothermia and oxygen can actually reverse some, if not all, of the brain injury.
Low birth weight babies are also peculiarly susceptible to suffer from cerebral palsy and immediate steps should be taken post-delivery to halt and reverse potential brain injury.
If your child suffers from cerebral palsy, it may be because the medical staff or physicians during delivery did not comply with the standard of care. It could also be the case that adequate steps post-delivery were not taken and much of the injury could have been reversed. Our firm conducts exhaustive investigations in these cases, and we leave no stone unturned in order to fully advise you on the legal rights of your child. We employ numerous outside medical consultants who will assist our legal team in every step of the process and ensure you get the legal advice you need most.

Erb’s Palsy
Shoulder dystocia occurs when a baby’s arm gets stuck in the birth canal. Malpractice here can result in an injury to the nerves of a child preventing proper movement of the child’s shoulders, arms, and hands. This condition is commonly referred to as Erb’s Palsy or sometimes Brachial Plexus Palsy. The brachial plexus is the the collection of nerves which are damaged in these cases.
When a baby is stuck in the birth canal, the physician or medical staff may apply too much force to the baby’s head in an attempt to remove the infant from the birth canal. If downward pressure is applied, the brachial plexus nerves can be torn from their roots in the spinal cord or ruptured. Though most shoulder dystocia deliveries restore full range of motion to the child as the body heals, in approximately 1 out of 5 cases, the injuries are lifelong paralysis of the child’s shoulder, arm, and occasionally permanent drooping of the lips.
Permanent injuries like this can cause lifelong damage to the child, restricting their ability to enter the labor force, causing severe disfigurement, and leading to an emotionally distressful childhood. Unfortunately, there are instances where the reason for the child’s damage is that the physician failed to follow proper delivery procedures.
If your child suffers from Erb’s Palsy, Brachial Plexus Palsy, Shoulder Dystocia injury, or any nerve injury after birth, their legal rights may be at stake. Contact Obstetric Malpractice Lawyer D. Hardison Wood today for a free initial consultation. 1-877-829-7211
